1. About GearShare
GearShare (“GearShare”, “we”, “us”) operates a peer-to-peer marketplace that connects people who want to rent or buy tools (“Renters”) with people who list tools for rent or sale (“Owners”). We are a technology platform; we are not a party to any rental or sale transaction, we do not own the tools listed, and we do not take title to any items.
2. Eligibility
To use GearShare you must be at least 18 years old, capable of forming a binding contract, and not prohibited from using the service under applicable law. By creating an account or using the service you represent and warrant that you meet these requirements.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms, at our sole discretion.
4. Listings & Rentals
4.1 Owner responsibilities
- Accurately describe each tool, including condition, specs, and any defects.
- Own or have the legal right to list each tool you offer.
- Maintain tools in safe, working condition and comply with applicable product-safety laws.
- Honor confirmed bookings and coordinate pickup/return in good faith.
- Disclose any hazards, restrictions, or skill requirements before handover.
4.2 Renter responsibilities
- Use tools only for their intended purpose and within advertised specifications.
- Follow all instructions, safety warnings, and local laws.
- Return tools on time, in the condition received (reasonable wear excepted).
- Pay for damage, loss, late returns, cleaning, or missing accessories as described in the listing.
- Promptly notify the Owner and GearShare of any incident, accident, or malfunction.
5. Payments, Fees & Deposits
Rental fees, optional purchase prices, security deposits, and any applicable taxes are displayed in the listing before booking. GearShare charges a service fee on top of the rental fee and may retain the service fee in the event of a cancellation. Deposits are released to the Renter after a successful return, minus deductions for damage, loss, or policy violations.
6. Cancellations
Both Renters and Owners may cancel a booking in the mobile app before pickup, subject to our Refund Policy. Frequent cancellations by an Owner may result in account restrictions.
7. Prohibited Uses
- Listing stolen items, counterfeits, recalled products, or items prohibited by law.
- Using the marketplace for commercial rental operations not disclosed to GearShare.
- Harassing, defrauding, or endangering other users.
- Circumventing GearShare to complete bookings off-platform.
- Scraping, reverse-engineering, or interfering with the service.
8. Reviews
After each rental, both parties may leave a review. Reviews must be honest, based on actual experience, and free of defamatory or unlawful content. We reserve the right to remove reviews that violate these Terms.
9. Disclaimers
The service is provided “as is” and “as available”. GearShare makes no warranties about tools, Owners, or Renters, including fitness for a particular purpose, safety, or legality. Users interact at their own risk. To the maximum extent permitted by law, GearShare disclaims all implied warranties.
10. Limitation of Liability
To the fullest extent permitted by law, GearShare’s aggregate liability for any claim arising from or relating to the service is limited to the greater of (a) the total service fees you paid us in the 12 months prior to the claim, or (b) $100 USD. GearShare is not liable for indirect, incidental, consequential, special, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless GearShare and its affiliates from any claim, damage, or expense (including reasonable attorneys’ fees) arising from your use of the service, your Listings or Rentals, or your violation of these Terms or applicable law.
12. Dispute Resolution
We encourage users to resolve disputes directly and through our in-app support. Where disputes cannot be resolved informally, they will be handled by arbitration on an individual basis under the rules of a recognized arbitration body, except where prohibited by law. You waive the right to participate in class actions.
13. Termination
You may stop using GearShare at any time. We may suspend or terminate your access immediately for any breach of these Terms, applicable law, or to protect users.
14. Changes
We may update these Terms from time to time. Material changes will be announced via the app or email. Continued use after updates constitutes acceptance.
